Who we are and what we are agreeing to

These terms are the contract between you and Mariano De Vitto, sole trader (autónomo, Spain), tax number (NIF) Y8773262H, owner of Cernoria. They are accepted when you create the account.

If you take out a paid plan you are acting as a consumer and you are protected by Spanish consumer protection law and by the rules on distance contracts.

What the service includes

Cernoria gathers job ads from public sources, compares them with your profile, scores them and generates documents from your information. Exactly how much —how many analyses, how many searches, which features— depends on the plan you take out and is set out on the pricing page.

Your account

You need an account and it is personal: it is not shared. You are responsible for what happens with it and for your profile data being yours and being true.

You may close it at any time from My account, and deletion is immediate.

What you must not do

• Use the application for anything unlawful, or to harass or impersonate another person.
• Upload other people's data without their permission.
• Extract the content by automated means, resell the service or give access to someone who has not paid.
• Attempt to circumvent the limits of your plan, or deliberately overload the infrastructure.

Plans, prices and payments

Published prices are in euros and include VAT. Payment is taken in advance, monthly or yearly depending on the cycle you choose, and renews automatically until you cancel.

Payment is processed by Stripe. Cernoria does not store card details.

The free plan is a 3-day trial from the moment you create your account. When it ends, your account and your data remain available, but searching and analysing new jobs requires a paid plan. The trial needs no card and never turns into a paid plan on its own.

If a payment fails, we notify you and try again. If it continues to fail, the account moves to the free plan: nothing is deleted and you may reactivate it at any time.

Changing plan and cancelling

You change plan from My account. Moving up a plan is charged as the difference, pro-rata for the time left in the period; moving down takes effect when the period you already paid for ends.

Cancelling is a button: no minimum term, no penalty, nobody to call. You continue using the plan until the period you paid for ends.

Right of withdrawal

As a consumer you have fourteen calendar days to withdraw from the contract without giving any reason, counted from when you subscribed.

The service is digital content that starts being supplied immediately: by subscribing, you agree that performance begins before those fourteen days are up and you acknowledge that, if you use it, you lose the right of withdrawal over the part already supplied. In practice, and so as not to argue about it: if you withdrew within the fourteen days and barely used the app, we refund you in full. Write to us at [email protected].

What Cernoria does not guarantee

Cernoria does not guarantee that you will get a job, interviews or replies. What it does is organise the search and prepare each application better.

The texts are generated by a language model and the ad data comes from third parties: both can contain mistakes. Review what you send. What you send to a company is your responsibility.

The service is provided as is. Everything reasonable is done to keep it available, with no guarantee that there will be no interruptions.

Liability

The owner is liable for direct damages attributable to him, up to the amount you have paid in the previous twelve months. He is not liable for loss of profit or for indirect damages.

None of this limits the rights the law gives a consumer and that cannot be excluded by contract.

Changes to the service and to these terms

The service can change: features are added and some may be withdrawn. If a change materially affects you for the worse, or if these terms or the prices change, we email you thirty days in advance and you may cancel before it applies.

A price increase never applies to a period you have already paid for.

Suspension

An account that breaches these terms can be suspended or closed, with notice unless the case is serious or unlawful. If that happens, the unused proportion of whatever you paid is refunded.

Law and complaints

Spanish law applies. Before anything else, write to us at [email protected]: most things are resolved by talking.

If we cannot reach an agreement, you may go to the courts where you live or to the European Commission's online dispute resolution platform.
